       the Mandatory Initial Session (M.I.S.)

 

MANDATORY INITIAL MEDIATION SESSION:

 

The recent L.4640/2019 has successfully introduced for the first time in Greece the mediation process through a mandatory initial session (M.I.S). This session can be held either in person or by video conference.

The purpose of this meeting is to obtain a clear picture of possibilities for out-of-court settlement of a specific dispute through a structured assisted negotiation.

After the M.I.S. and ideally before the deadline for submitting proposals, the parties decide whether to submit their dispute to mediation.

If they (parties of dispute) proceed with an agreement to be included in the procedure, while they are in mediation, the judicial deadlines are suspended.

The final mediation agreement excludes the filing of a lawsuit on the same matter.

The parties to a dispute and their legal representatives, before submitting proposals and starting the judicial process, must be informed about the possibility of out-of-court resolution of their dispute according to its nature and specifics.

The M.I.S. (mandatory initial session) is a prerequisite for the admissibility of the action.
